Default Background Qualifications and Waiver???

I'm actually in a situation that requires some aid. I'm trying to become an IS guy: I qualify where the ASVAB is concerned, my physical is good, but a seat hadn't opened up for 'A' School for this job, and my background is a little questionable: I have two fines that I already paid off before I even enlisted: one was for failing to file my income tax back in 2011 and the other was a loitering fine. My Recruitment Officer is saying that that is going to get in the way of me getting the job, however, it doesn't say that either of these will make me negligible for the job in the PS1 job rating book, or on any official Naval website that states the job ratings: it only says:

"Applicants must be U.S. citizens and meet eligibility requirements for continuous access to sensitive compartmented information (SCI). Eligibility for a top secret clearance is determined by the results of a Single Scope Background Investigation followed by a re-investigation every five years. Adversely adjudicated drug abuse offenses will not receive waiver consideration."

My question is, is it possible to request a waiver for the job provided a seat opens up? Am I totally, and finally disqualified based on two measly little fines that happened prior to enlistment? I don't want anything getting in my way when, and IF a seat opens up because right now they have me in the HMDA program, and I don't want this, however they told me if I don't take this I risk being kicked out of the Navy...great...

Anyway thanks in advanced guys for the replies/responses.

If there's a will theres a waiver. This is absolutely a waiverable situation. You will have to clarify that the things that happened to you in the past wont happen again, with more detail. It may delay your ship out date, but if you're absolutely set on IS then this is the way to go. You could call your recruiter and talk about further details.

Ok. First off I want to again thank you for responding any and all who do so. I've asked my Recruiting officers to submit a DAR to change my current rate: they told me in such a way that "Any job in Intelligence with such fines you aren't eligible for. In fact, one of my recruiting officers told me that it was off the table, which suggested that they in someway either WON'T or CAN'T consider getting me the waiver...

I can't understand their thinking when I meet the requirements for the ASVAB, the physical, and the waiver...the only possible requirement that I don't meet is potentially the availability of the seat for "A" School...which i was told if someone disqualified/failed/or was kicked out, then I would get the opening, but as of now, I'm still in line for HDMA school.

I'm not an adjudicated drug offender (I have no drug offenses/uses on my record, not even a possession charge) which is the only thing that would utterly/totally disqualify me from a waiver...but it seems as if they won't go that far for me...Would I have better luck going up the chain of command speaking directly with a PS1/another chief of some kind?

Thanks for the help thus far Spook! I'm just trying to get the most out of my time of service as I can!!

Sounds like a scare tactic. I was in a very similar situation. I scored high in the ASVAB and they gave me 3 choices when I was to choose a job. I already had a list in my mind but they wouldn't budge in MEPS. So I walked out even though they yelled at me. Went back to my recruiter's office to tell them what happened, they got the phone call at MEPS too. We decided to go back to MEPS and choose a job then submit a DAR for it. The choices were MM(subs), AECF (FC/ET), or Nuclear. I chose AECF even though I really wanted GM. Got the DAR submitted and waited... waited... waited ... for 5 months. As my ship date got closer, I was getting desperate. I learned on this site that DARs don't do you any good pretty much, which was my case in point. I got desperate that I ended up looking for alternatives. Began calling the Coast Guard recruiting station and said what's up. Told my DEP station if I could get a DEP discharge and leave the Navy for the USCG... that or not ship out at all. I came to the conclusion that the chain of command was useless as we had a change in LPO and LCPO who don't know my situation. They heard my cries after many times, so they listened. I told them that I was set to go to boot any moment now and that I'm packed up ready to leave the next second. So what they did was wait for an A school opening and had me take it. I left for boot camp a week earlier than expected.

As for you, since you're so set in IC and already signed up the contract for shipping out as an HMDA, you still have time to change things in you favor. You're not bound to leave for boot camp at all unless you make the 2nd swear-in and actually ship out on your ship date. You don't need to ship to boot camp with your current contract. What are they going to do? Yell? Ask for a DEP discharge?

You can't waiver security requirements. If NAVCRUITCOM or DONCAF has set standards that those conditions DQ you from then it's going to be a non-starter.

That being said, once you're in the Navy you can work the system much better than you can now. You'll be able to speak with leaders in the rate directly and can work with the adjudication folks to see what can be done to help you out. You'll also be in a better position manning wise if there is an opening. Right now as a civilian, these options aren't going to be open to you. Nothing you can do about it, just how it is.

Also bear in mind that your recruiters, the stations, and even MEPS have pretty much nothing to do with what becomes available when. Those numbers come from the TECHADs and ECMs, both of which are outside of those organizations and they have no sway over. So what jobs become available are just the numbers that are passed to them, then passed to you if needed. They don't get a say in what changes, when, or how.
