Separation?
 
My son left for BC on 12/6, and called tonight (12/21/18) saying he was coming home. Something about his legal issues coming back up - does that make any sense?

He got an MIP (minor in possession) last January and was on probation when he enlisted. We went to court to have it dismissed because he was going into the Navy, but he had to go back to submit proof he was enlisting. He did that and we thought everything was fine.

He had ranked up to E3 and was responsible for 80 recruits and was going to be doing something with a sword at graduation. He is completely devastated.

They said he could reenlist in 6 months. Will they actually take him back? I've seen a number of places where it isn't likely once you've been separated.

Any insight? Can he appeal? Should he?

Might I ask if this violation was on his enlistment paperwork? If it was not, then it is looked at as omitting pertinent information. You might want to call and talk to his recruiter that put him in. He would have needed a waiver from the Navy to enlist with a violation of that nature. Even if the court dismissed it.

Yes it was disclosed. There was some back and forth on getting the court 'proof' which was up until the middle of November. He went in on 12/6. I'm wondering if it's paperwork overlap?

My best guess on this, your son shipped out prior to having his waiver in order, and that should fall on the recruiter...both my sons needed waivers to enlist, and it took on average 3 months to get cleared. One was simple as it was for tattoos, the other was a court case that was dropped...that one took the longest even with the DA's signature.
